THE CROSSROAD OF DEMOCRACY

Never before in American history have “We, the people…” been more dismissed in all considerations of our government, as laid out in our Constitution, “and that government of the people, by the people, for the people, shall not perish from the earth” (Abraham Lincoln, “The Gettysburg Address”), is now a government for a certain elite few, our elected officials seemingly bought and owned by special interest, no longer emboldened by moral conviction to uphold the Freedoms that our Founding Fathers inked with wisdom following the Revolutionary War wherein Patriots shed their blood for those precious Individual Liberties which were paramount in the consideration of every word put forth by great men, who fully understood, because they had lived under the thumb and dehumanizing effects of tyranny.

With all due respect to our Public Servants, let me say I do not envy your position, but it appears we are being led down a road returning us to tyranny and are not deluded into concluding anything less.  Democracy, in its full faith and intent, is, in practice, now just a myth in America, and the voices of “we, the people…” have been reduced to a faint whisper, as if on bended knee,  left to grovel before dictators. It is time to reconsider  the voice of “We, the people…” wherein all power is inherent (Article 1, Section 1, Tennessee Constitution).

Plato and Aristotle define a tyrant as, “one who rules without law, looks to his own advantage rather than that of his subjects, and uses extreme and cruel tactics—against his own people as well as others”. Does this not define Judge Randy Kennedy’s 7th Circuit Court, protected by our current Court of the Judiciary, Board of Professional Responsibility, law enforcement agencies with knowledge of the criminal conduct carried out by this court and its practitioners routinely, systematically, and without regard for the slave-auction  machination used to barter the freedoms and properties of vulnerable humans, especially the elderly who have no voice, locked away and silenced?

Paralyzed by the left-right bickering, void of the consideration of the common welfare, a ship of fools steered on a course directed by authoritarianism, listing towards the rocks upon which Rome was wrecked.

“I know of no safe depositor of the ultimate powers of society but the people themselves; and if we think them not enlightened enough to exercise their control with a wholesome discretion, the remedy is not to take it from them, but to inform their discretion by education.  This is the true corrective of abuses of constitutional power.” (Thomas Jefferson)

Our Legislators move quickly to remove the Occupants from Legislative Plaza, yet I wonder how many have crossed the street to listen to their grievances?  Few, if any?

I have.  I took the time.  I wanted to know.  Granted permission to speak before them, I was cut off-by an attorney and this attorney does not spend his nights sleeping in the cold with the Occupants.  The Occupants were very courteous and just wanted to be heard.  I left, still not knowing exactly what the spine of the Occupants is, but I was willing to listen.  And if nothing else, they represent voices from “We, the people…”,  voices longing to be heard, that must be heard if we are going to continue to proclaim America a Democracy.

Isn’t this a sad testament to our legal system, that judges and attorneys are the most untrustworthy, yet vested with a duty to their oath to be protectors of the Constitution, honest advocates for the Law.

What was formerly a first command of the Judicial Code of Ethics,  “shall rule consistent with the Constitution”.  Yet judges of the lower courts seemingly loathe the Constitution, for it stands in the way of tyranny and trumps any law conveniently used to side step the intent of our Founding Fathers and the Patriots who shed their blood for “life, liberty and the pursuit of happiness”.

I believe in the power of prayer with the conviction and faith of a man stripped of “life, liberty and the pursuit of happiness.” (these exact words were petitioned for in The Conservatorship of John Daniel Tate and Judge Randy Kennedy signed away these fundamental, unalienable rights based on nothing but grossly perjured hearsay evidence. Petition for Conservator.)

Do your good deeds as if no one will ever know except God, if you believe.  Fight the good fight even if it means losing all.  Rest in peace knowing you gave your all.

I believe in the Power of prayer, but let me ask you this question.  Where we would be today if the Patriots had just prayed and done nothing else? I wonder what would have become of America if they had stayed bowed on their knees as the red coats showered their women and children with bullets and bombs?  I wonder where we would be today if we had not fought for the rights of Religious Freedoms?  I’m glad there were those who took the gun in one hand, with a Bible in the other, and stood up for freedom and opposed crimes against humanity, willing to sacrifice their lives.

Stay in the comfort of your homes and do nothing and watch as Democracy vanishes, leaving your children to a government of tyranny you did nothing to stop.  Sit around, scoff and murmur about the individuals who have the courage to be a fool for liberty.

Not everyone is “called” to lead the charge to protect Democracy, but we are all compelled to do our part, if only in living free and promoting the fundamentals of individual liberties, even when we may not agree with someone else’s political leanings, religious convictions or other polarizing topics.  Unfortunately, we are being conditioned to accept tyranny under guise of only remnants left of true Democracy.

It appears our government is counting on the citizenry to be side-tracked and distracted by left/right bickering while we are all missing the fact that Democracy has been left behind, lost in the chaos created by political maneuverings.

During this chapter of American history, will you be one who stood up to tyranny and called it what it is, or will you shirk your duty to this incorruptible responsibility?  When your grandchildren ask, “where were you?” will you be able to say, “I was there, I spoke out, I stood bravely and looked them all in the face, and you are free today because I was willing to stand, often alone, against injustice.”

Today, face yourself with this thought: at the end of your life, lying on your deathbed, looking back on all you’ve done, will you be able to face your Maker and say, “I fought the good fight, I finished the course and I kept the Faith, I came out from the closet of prayer and I sacrificed, even all, for the greater good”.

It is the day of the New Patriot.  Sit back and do nothing.  Pray and do nothing. Live and do nothing.  God cannot move through a heart that is unmovable, but stand boldly before the face of tyranny and fear no evil, and God will be moved to stand beside you, and the conviction in that Power is undeniable and that voice will be heard.

There is no better time than now, there is no greater voice than yours.

Other Voices gives an opportunity for “We, the people….” to express our concerns and grievances, specifically to the abuses occurring in Judge RandY Kennedy’s probate court, the systematic ruining of lives and looting of estates under color of law and guise of protection.  This post comes from Don Acree, faithful advocate whose father is a prisoner of this court.

Dear TN Senators and Representatives, Judiciary Members, Writers, Others:

Senator Mae Beavers (Chair, Sen. Jud. Cmte) has proposed changes to the Conservatorship law: http://impeachrandykennedy.files.wordpress.com/2012/02/senate-bill-2519-by-beavers.pdf

They are better than Sen. Haynes’ proposal, which is worse than no change.

It addresses some issues (euphemism for ‘crimes’) that occurred in the Ginger Franklin case and in the Danny Tate case in Davidson County Probate Judge Randy Kennedy’s court:

Unfortunately, it does not recognize the depth of mendacity in Probate Courts around the country and particularly in Davidson County, TN.

Best Provisions:

• It will make the court quickly hear cases where a ward petitions to end their conservatorship (Ginger Franklin)
• Makes is clear that no medical proof is required to terminate a conservatorship (Ginger Franklin).
• Allows a respondent to manage his own money and hire an attorney of his own choice until a Conservatorship is implemented (Danny Tate)

Other good but defeatable provisions:

• Provides for no emergency conservatorship (also the Danny Tate case, as in theMaurice Acree case), as Judge Kennedy frequently grants “temporary conservatorships” for which there is no provision in law.  Whether Judge Kennedy will actually abide by this or still continue to issue “temporary conservatorships” is unclear.  It seems to me there is a semantics problem here that Kennedy could circumvent by saying that “temporary” is not “emergency”.
• Only allows for ex parte-granted conservatorships where 3 physicians swear the respondent is physically  not able to attend.  This is a laudable reform, but unfortunately, like in the case of Dr. Maurice M. Acree, there are enough “probate racket” doctors out there to defeat this.  The average citizen reading this law probably thinks that different attorneys and doctors will be involved with each case.  Unfortunately, certain lawyers become “probate sharks” and they look for potential wards to scam, and they search for unscrupulous doctors to assist them in crime.  Dr. Acree’s attorney found two doctors that diagnosed him with Alzheimer’s when it wasn’t true.  The Kennedy court denied the family request that Maurice Acree be evaluated by his hometown doctor at Vanderbilt Medical Center.
• May charge the expense of a conservatorship proceeding to the ward’s estate, but isn’t required to.  There will still be “probate shark fishing” under this provision, but it will be used by the honest judges for effective change.

What Reform Should Contain:

• Conservatorships should be moved OUT OF PROBATE COURT.  Danny Tate is correct, “It is an utter contradiction of jurisprudence for a court of liquidation to adjudicate preservation.”  In the Kennedy court, it’s Conservatorship straight to Bankruptcy.
• The Respondent should NOT JUST have the right to MAKE AN APPEARANCE IN COURT, IT SHOULD BE REQUIRED!  In the case of Maurice Acree, his two attorneys (June House and Lesa Skoney) told the court he waived his right to be in court, and it was all a lie.  He  had no notice of it.
• The Respondent should then have the RIGHT TO A JURY TRIAL!  Yes sir, people, no one should be imprisoned inside or outside a jail without a jury’s decision.
• If the Respondent cannot make it to court, then the COURT SHOULD GO TO THE PERSON (in home, hospital, wherever) and the Jury should go, not the judge.
• The Jury shall be informed that the law is to TAKE AWAY AS FEW RIGHTS OF THE RESONDENT AS POSSIBLE.  In Kennedy’s court, every conservatorship is plenary.  (Most demented people still know where they want to be, and their wishes should be obeyed)

• No conservator should be appointed if there EXISTS FAMILY MEMBERS TO TAKE CARE of the Respondent.  This is already the law in Pennsylvania.
• NO ATTORNEY should be appointed conservator unless already a direct family member (parent, child, sibling, half-sibling, etc.), and they are not to bill their services at the high rates atty’s charge for legal work.  (i.e. $150 to $400/hr).  This is not legal work, for the most part.

There have been true advocates who have kept the faith throughout this “court ordered hell” and I want their words to be put forth in this post.  This battle to expose and effect change within the probate court and conservatorship/guardianship abuse has been the most challenging chapter of my life, and the lives of unaccounted for legions who have been put away and silenced.  To know that there are a few that have faithfully stood their ground, well, I want their words to be heard.

Danny – I wrote to Senators Overbay, Bell and Beavers with the following email: 

Dear Senator ______,

It has come to my attention numerous times that the Proposed Legislation for Conservatorship Reform and Alternative Solutions, presented by Danny Tate has not been taken seriously enough nor has this wonderful man and humanitarian been treated right by the judicial system. 

I have known Mr. Tate for over 30 years and for whatever reason he finds himself in this situation is totally and completely unfair and unconstitutional. I am not clear on as to WHY this is continuing, as Danny has been back on the right track and trying to provide for his children for a very long time now and all he requires is the money and personal responsibility that he earned and is rightfully his. It feels like the system has made a mockery of his life. You have the power to change this. 

It is unconscionable and getting old already. For God’s sakes, give the man his life back. It’s these exact kinds of situations that can drive a person over the edge. Are you willing to be responsible for someone so great to go off the deep end and even consider ending it all? Personally, I don’t know how he endures this mental anguish and financial torture – I certainly wouldn’t remain as strong as he has been. I can’t imagine how the people involved can sleep at night or live with themselves, all for the sake of ‘procedure’!?!?! Each and every human being and case is different so I support Danny Tate 100% and ask you to consider removing the monkey wrench from the works. DO THE RIGHT THING – not according to the red tape but according to your heart. Put yourself in his shoes and ask yourself how YOU’D like to be in his situation where the courts deem what’s rightfully his to be taken away.

Amazing that they continue to refuse to see the obvious solution to the bulk of the C/G problem. When will they realize that WE will not be ignored? It’s bewildering. I hope that some of these folks that keep urging you forward start taking some action and email the appropriate parties. This battle is too big for one man to shoulder alone. Email people…five minutes out of your life to email and state your case.

True friends of Danny, take up the cause and email the senate judiciary in Tennessee. Take five minutes out of your life and send an email aksing for REAL reform. Get conservatorships out of the probate court, require documented medical proof before someone can be conserved, and demand that the person being conserved be notified and have the ability to speak in court before an order is handed down to conserve. We all pray for our friend, Danny, but it only takes a few minutes of action to truly help Danny and the others who can’t speak for themselves to further the cause.

 Even those of us who e-mailed the committee lists before, need to follow up with another e-mail. They may have the best of intentions, but if the state legislators allow themselves to be snowed by just implementing reforms INSIDE the probate court, Kennedy and company will find the loopholes to keep their gravy train going on. We have to insist these cases be removed from probate court using Danny’s proposed model board or some acceptable solution.

ok, I’ve just e-mailed The Diane Rehm Show on NPR numerous times. I hope she would have her staff research your situation and have you on the show. I’ve posted on her FB page and on the Rachel Maddow Show FB page too. I contacted SYNC, the local entertainment newspaper. FYI: The only time I contacted Nancy Amons was to be sure she knew when you or Ginger Franklin had a court date approaching so she would be there with cameras. She interviewed me once. I told her I’d known you since high school and I originally got interested in the case because it was about a friend; but the more I researched and found trampling on citizens rights in this way was a huge problem all over the country, I felt I had no choice but to get involved. The interview was not aired.

I just saw the story on WSMV about you and Ginger and Mrs. Tinnon…and Gary Odom on the legislation pending….and Kennedy wouldn’t talk to them! I know you are reponsible for all of this and whatever gets done…you were called Danny! God Bless you in everything you do! Well done! Keep the faith!

Danny….how about not only taking it out of Probate…but how about having a law that states that NO ONE who is a LAWYER can be a conservator? I know other people who are accountants and bookkeepers who are conservators and as you may remember I was until the court found some money! NO LAWYERS!

Also….we need the law to say that NO CONSERVATOR CAN HAVE MORE THAN 5-10 conservatees….and that being a conservator can not make up more than 10% of their income!

 I know some of those lawyers have 30-50 conservatees at a minimum of $250.00 per hour appt by the court….and there is NO way they can spend one day a month on each one…and that is already required by the law but not enforced.

There are others who have “kept the faith” and realized the injustice.  I realize many were duped by Judge Kennedy when he announced my conservatorship “terminated”.  It was anything but.

Bottom line, this is an issue dealing with crimes against humanity, exploiting the elderly at their most vulnerable time in life.  I believe we have a moral obligation to try and protect.

We live in a day and time where government intrusion via probate court and family court works in direct contradiction to what these courts are charged to protect: “the best interest of…”

In closing, I need a handful of volunteers to hit the streets with petitions to gather signatures to Impeach Judge Randy Kennedy.

If you live in Davidson County and are willing to volunteer a few hours to this effort, it would be greatly appreciated.  I cannot do this alone, but will if I have to.  I already have one volunteer.

Also, I believe in second chances.  If there are those who fell off the wagon of advocacy and want to jump back on, you are welcomed.  Just don’t show up with any ulterior motive.  There’s no money, no glory, no chance for romance, no room for underhandedly promoting another agenda.  Come with clean hands.  And you don’t have to spend a dime, just time.  In fact, your money is no good here.  And for those that profited off this cause, find some other unsuspecting victims, there’s no room for that here.

There are others who I have not quoted here, but just know your faithful efforts have been appreciated.

In closing, realize this, the rewards this cause brings are treasures stored up in heaven and within you soul, knowing you came and left with clean hands and a pure motive, gave of yourself selflessly, and knowing in the quiet prayers of your closet, you are truly saving lives from a life of “court ordered hell”.

SMOKE AND MIRRORS PROPOSED LEGISLATION

Let me explain this in as simple terms as possible addressing the proposed legislation addressed in the previous post.

There are two (2) proposed legislations being offered up and you can read them both below:

1. Senate Bill 2398 by Haynes (Senator and Attorney)

2.Senate Bill 2519 by Beavers (Chair of the Senate Judiciary Committee)

Here are two more links that will give your further insight into the two proposed legislations.  Now, make sure you continue to follow my line of thinking and what the legislators are trying to pull off here

Now, at face value, it’s obvious that Senator Beavers proposed legislation  is the obvious choice, but what it appears to be the effort here is leaving us with a choice of the “lesser of two evils”.

IT DOES NOT MATTER WHAT LEGISLATION IS PASSED, IF THIS LAW REMAINS ADJUDICATED IN PROBATE COURT, THE PAGES OF PROPOSED LEGISLATION MIGHT AS WELL BE BLANK, BECAUSE KENNEDY AND HIS PROBATE PRACTITIONERS WILL NOT ONLY CONTINUE TO IGNORE THE LAW BECAUSE THEY KNOW THEY ARE PROTECTED, THEY WILL FIND THE LOOPHOLES AND CIRCUMVENT ANY REFORM BEFORE THE INK IS DRIED ON THE NEW LEGISLATION.

Again, both legislations are an attempt to champion the more obvious favorable legislation, Senator Beavers, but it’s ALL SMOKE AND MIRRORS if this law continues to be adjudicated in probate court.

Mark my words, no matter what “reform” wrought by either of these proposed legislations, one year from today you will have a whole new line of conservatorship victims to parade in front of the camera who have been bankrupted under color of law and guise of protection.

Here is the proposed legislation, once again, that I presented to the legislature.

Now, any reasonable person can read that this proposed legislation addresses and solves the fundamental problem with a law of preservation (Conservatorships/Guardianships) being adjudicated in a court of liquidation (Probate, Judge Randy Kennedy, 7th Circuit Court, Davidson County, TN) Oh, and in the #1 Most Corrupt State-Tennessee.

I’ve endorsed Sen. Mae Beavers at this site.  I’m afraid she’s missing the big picture (or maybe she’s not, but hopes we are).

Reader, we have Dog Courts today and a dog has more consideration and legal rights than a “conserved” ward of the state.  We have Criminal Courts where murderers have more due process consideration and legal rights than a “conserved” ward of the state.  Can we not consider our vulnerable and the elderly over and above at least these?

Left in the court of Judge Randy Kennedy, an unelected tyrant sitting appointed on an elected bench, routinely ruining lives, routinely ignoring the law, routinely ignoring due process, routinely ruling in favor of his campaign contributors to an uncontested re-election, routinely conserving and bankrupting under color of law and guise of protection.

Here’s my take on it.  Senator Haynes legislation is nothing more than a boxer taking a dive so that Senator Beavers legislation will appear to champion reform.  Now, it’s easy to immediately dismiss Senator Haynes proposed legislation, for it was authored and offered by an attorney (BIG RED FLAG!) and reads like Mein Kampf.

Senator Beavers or Joseph Haynes (attorney) could propose legislation that trumps the Constitution or Magna Carta, but if this law is left adjudicated in probate court, the pages of Senator Beavers proposed legislative reform to the Conservator Code might as well be a blank page, for it will have absolutely no merit in Judge Randy Kennedy’s probate court.  It’s that plain and simple

Now, follow the instructions below and let your voices be heard.  Let’s see if we are living in a Democracy in which “We, the people…” are inherent with ALL POWERS.  Let’s see if our Public Servants are still listening are just playing tyrannical games where, once again, the wishes of the people are left as a lost consideration.

Judge Randy Kennedy must be impeached.  His court remains under scrutiny.

Legislation could limit judges’ power – WSMV Channel 4

I’ve seen this legislation proposed.  It would be easy for probate practitioners to continue to do their dirty work as long as Kennedy, and the legacy of Davidson County Probate Judges like him, remain on the bench.  This legislation is “smoke and mirrors”.  I’ve presented legislation that would solve the fundamental problem.  The fact that a law intended to preserve estates is adjudicated in a court that liquidates estates is an utter contradiction in jurisprudence.

Please read the legislation I’ve proposed and follow the plan of action.  It will require public outcry.

The Law is Written in King James, Evoking the Bible…

Read this story of Gideon as presented at Wikipedia, as told in the book of Judges from the Old Testament.  How coincidental this story is told in the book of “Judges”.  I was pointed to this story from three separate, but faithful advocates just today, who do not know each other, and live in different states.

 This victory requires those fit for battle, chosen and convicted.

In the movie, “Glory”, Matthew Broderick’s character asked, “If I fall in battle, which one of you will carry the flag?”

I ask the same of you.

There are lost legions of souls locked away and silenced, while their golden years prove golden only for those who profit from their demise.

I implore every reader to reach unto their higher self and answer this call. Pick up the flag of the fallen and march onward to fight this crime against humanity.

When history plays its hand, and it will, which side will you have stood on?  As Bob Dylan said, “You gotta serve somebody…”

Tomorrow, Impeach Randy Kennedy goes on the chopping block.  I only have one regret.  I once wrote, “I’m smarter than all of ‘em.”  That is my regret.

“Smarts” has no bearing.

What I should have said was,

“Truer than all of ‘em”.
